Terms of Service

Version 1 · Effective [[EFFECTIVE DATE]]

This is a plain-language description of the rules for using FansGiving League, written to be actually read. It is not legal advice, it has not been reviewed by a lawyer, and where it conflicts with a more formal agreement you've separately signed with us, that agreement controls. If you need legal advice about your own use of the Service, talk to your own attorney.

The words we use

This product invented some vocabulary. Here is what each word means every time it appears below.

We, us, our, FGL
FansGiving League, operated by [[LEGAL ENTITY NAME]].
the Service
The FansGiving League website and everything offered through it.
Fan
Anyone with an account who pledges.
Pledge
Your stated intention to give a set amount for each of a team's stats in one game, capped at a ceiling you choose. It is a plan, not a payment.
Rate
The dollars you attach to one stat — say $2 per touchdown.
Ceiling
The most your pledge can ever come to, set by you before the game. Nothing you do during a game can raise it.
Accrue
What happens to your running total as your team earns the stats you pledged on.
Settle
The point after a game when we work out the final amount each pledge came to.
Delivered
A gift we have evidence actually reached a charity. The only figure we will call fact, and the only base a match draws on.
Charity
An organization listed on the Service that a pledge can name.
Tier
How far we stand behind a charity — partner, verified, listed, or off-platform. It describes the evidence we have, not how good the charity is.
Match
A commitment by a sponsor or a club to add money on top of delivered fan giving to one charity for one game, up to a cap.
Sponsor
An account we have granted the sponsor role for a team, so it can create matches for that team.
the wall
The public page for a game, showing both fanbases' running totals side by side.

1.The Service

FansGiving League (“FGL,” “we,” “us”) is operated by [[LEGAL ENTITY NAME]]. FGL is a companion product for watching NFL games: you name a dollar amount you're willing to give per stat your team records — points, touchdowns, first downs, sacks, interceptions — watch the total add up live on the wall, and after the final whistle you give the settled amount directly to the charity you picked.

FGL is not a charity, a nonprofit, a fundraising platform, or a payment processor. We do not solicit, collect, hold, or transmit charitable gifts on anyone's behalf. We are a scorekeeper and a reminder — the giving happens between you and the charity, on the charity's own site.

By creating an account or using the Service, you agree to these terms. If you don't agree, don't use the Service.

2.Eligibility and your account

You must be at least 18 years old to create an account. When you sign up, you attest that you meet this requirement and that you accept these terms — that attestation is a checkbox you affirmatively check, not a default, and we record when you did it. We don't independently verify your age; we rely on what you tell us, the same way we rely on you to actually make the gift you pledge.

You need an email address and a password to register. We don't verify that you own the email address you provide beyond a self-serve confirmation step you control yourself — marking an address “verified” on our end means you clicked a control, not that we've confirmed your identity or that the address is really yours. Don't rely on another person's account “verified” status as proof of who they are.

You're responsible for keeping your login credentials to yourself and for everything that happens under your account. Tell us if you think someone else has access to it.

You choose, at signup and any time after, whether your name appears on public leaderboards or as “anonymous.” That choice controls display only — it doesn't change what we record internally about your pledges.

3.What a pledge is — and isn't

A pledge is a statement of intent: you choose a team, a charity, a per-stat rate (for example, $10 per touchdown), and a ceiling — the most you will ever owe for that game, no matter how the game goes. As the game is played, the wall shows what your pledge has accrued against live stats; the number that matters is the one calculated after the game ends, against the league's official final statistics, capped at your ceiling.

You may also set a minimum — an amount you commit to give even if your team's night comes to less than that. A minimum replaces the rate total when the rates come in under it; it is never added on top, so what you are expected to give is always the larger of the two, and never more than your ceiling. Setting one is optional, and a pledge without one is worth exactly what the stats earn, including nothing.

A pledge is not a contract to pay FGL, and it does not authorize us to charge a card, debit an account, or collect money from you in any way — we have no mechanism to do any of that. It is a promise you make to yourself and to the charity you named, and your own word is what carries it.

You can cancel a pledge yourself, any time before the game's settlement process begins after the final whistle. Once a pledge has settled, it can no longer be cancelled, since by then it reflects what actually happened in the game and is what you're expected to give.

4.We never handle your money

This is the single most important thing to understand about FGL: we do not collect payment information, and we do not hold, transmit, or process funds at any point, for any pledge, match, or gift. There is no card on file, no wallet, no escrow, and no payment provider integrated into the Service.

After a game settles, your account shows the amount your pledge earned and a link to give it — on the charity's own website, or on the charity's Every.org page. You complete that gift yourself, directly with the charity, using whatever payment method that charity's own site accepts. The charity's receipt is your receipt; we don't issue one, because we were never a party to the transaction.

Because we never touch the money, we cannot guarantee that any individual fan actually completes a gift after settlement — that part runs entirely on your honor. What we can tell you is what tier of confirmation exists for the charity you chose; see the next section.

5.Charities, and what we can confirm

The causes you can pledge to are chosen by the club you are backing and its sponsors, one game at a time. We do not offer you an open list of charities and you cannot add one — a club names what its own fans play for, and FGL vets every organization before a club can name it.

Every charity you can pledge to is presented as a registered 501(c)(3) organization. But “confirmed by FGL” means different things for different charities, and we show you which one applies rather than blur the difference:

Only gifts to charities at a tier we can confirm count toward any public “Delivered” total the Service shows. We don't control, endorse, or take responsibility for any charity's programs, finances, or use of funds — verification tells you how confident we are that a gift arrived, not what the charity does with it afterward.

6.Sponsor and team matches

A sponsor or team owner can set up a match: a commitment to add money on top of what fans give to one charity for one game, at a ratio they choose, up to a cap they set. Matches are calculated only against gifts that have already settled as Delivered, after the game ends, in the order the underlying pledges were created, until the ratio times the delivered amount or the cap is reached — whichever comes first.

A match is never a live, per-fan promise. You will not see “your gift is being matched” while a game is in progress or while you're pledging, because there is nothing to match yet — matching draws against confirmed, already-delivered gifts, allocated after the fact. Only charities at our Confirmed Partner or Verified tier can carry a match, because a sponsor's or owner's money should only ever stand behind gifts we can actually confirm.

If a sponsor's match cap is reached before all delivered gifts are allocated against it, later fans in the queue simply don't draw a match — their own gift to the charity is unaffected either way.

7.What we show about you

The giving wall is public. When you pledge, we show your pledge on it, and whether your name appears is your choice: at signup you pick whether to be named on leaderboards or to appear as “a Patriots fan,” and you can be named on one game and anonymous on another. We also show the charity you named, the amount per stat, and your running total.

Choosing to be anonymous hides you from the public wall, not from the charity. A charity’s own representatives can export the gifts recorded as delivered to them, and that export includes your name and email address even if you chose to appear anonymously. We do that because a charity issuing a receipt has to know who to issue it to. If you do not want a charity to be able to see who you are, do not pledge to that charity.

That export is limited to gifts recorded as delivered to that one charity, and only to people we have granted the nonprofit-representative role for it. It is not a general donor list and it is not sold, shared, or offered to anyone else.

9.Not a wager

FGL is not gambling, wagering, or a game of chance, and it is not offered as one. Not a wager. No prize, no payout, nothing at stake but the gift you choose. Nobody wins money on FGL — not you, not another fan, not us. There is no jackpot, no house, and no way to get money back out of the Service, because no money ever goes into it.

What you set in advance is the size of a charitable gift tied to your team's performance, bounded by a ceiling you choose. The outcome of the game changes how much you give, and to whom you already decided to give it — it never changes whether you receive anything, because you never do.

10.Acceptable use

When using FGL, you agree not to:

We can suspend or terminate access for anyone who violates these terms, at our discretion, and we can remove or correct any figure the Service displays that we believe was produced through misuse.

11.Suspension and termination

You can stop using the Service whenever you like, and you can cancel a pledge yourself right up until it settles. Because we hold no money, closing your account costs you nothing and there is nothing to refund.

We may suspend or close an account, revoke a sponsor, team, or charity role, close a match, or remove a charity from the Service if we believe these terms have been broken, if a charity’s standing changes, or if leaving it in place would mislead the people using the wall. Roles here are granted by us and can be withdrawn by us. Where we can give notice first, we will.

Removing a charity does not undo pledges already recorded to it, and does not mean you should not honor a gift you already intended. It means we stop offering it as a choice.

12.Intellectual property and team marks

The FansGiving League name, logo, and the design of this site belong to us or our licensors. You may not use them without our permission, other than to refer to the Service by name.

FGL holds no license to, and does not claim, any rights in NFL, team, or player names, logos, or marks. Team identity throughout the Service is shown as plain text — a city and team name — specifically because we don't have rights to display club logos or wordmarks. Nothing on FGL implies affiliation with, sponsorship by, or endorsement from the NFL, any NFL team, or any player, and references to teams and games are purely descriptive, identifying the real-world matchup a pledge is tied to.

Charity names and, where shown, logos are used solely to identify the organization a fan can choose as a recipient, and remain the property of those organizations.

13.Disclaimers

The Service is provided “as is” and “as available.” We don't warrant that it will be uninterrupted, error-free, or available at any particular time.

Live stats shown during a game are provisional and can change — a call can be reversed, a stat corrected — and the figure that ultimately governs your pledge is calculated from official league statistics after the game, not from what the wall showed in the moment.

Because gifts move directly from you to the charity you choose, and we are never a party to that transaction, we make no warranty about whether any particular gift is completed, how a charity uses funds it receives, or the accuracy of any figure a charity or Every.org reports back to us. Nothing on FGL is tax advice; keep the receipt the charity gives you for your own records.

14.Limitation of liability

To the fullest extent the law allows, FGL and its operators won't be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any charitable gift you make or fail to make.

Our total liability to you for any claim arising from the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim — which is $0, since FGL has never charged a fee or collected a payment from any user — or (b) $100.

15.Disputes

If something goes wrong, tell us first. Most problems here are a wrong number or a missing pledge, and those get fixed faster by email than by anything formal. Write to us at [[CONTACT EMAIL]] and give us a genuine chance to sort it out.

How a dispute is resolved if that fails — in court, or by arbitration, and whether class actions are waived — is [[DISPUTE RESOLUTION]]. This is deliberately blank rather than guessed at: it is a real legal choice with real consequences for your rights, and it should be made with counsel rather than inherited from another company’s terms.

16.General terms

You agree to indemnify us against claims arising from your misuse of the Service or your violation of these terms. If any part of these terms turns out to be unenforceable, the rest still stands. Our failure to enforce any part of these terms isn't a waiver of it. You may not assign your rights under these terms without our consent; we may assign ours in connection with a merger, acquisition, or sale of assets.

These terms are governed by the laws of [[GOVERNING LAW JURISDICTION]], without regard to conflict-of-law rules, and any dispute not otherwise resolved will be brought in the courts located there.

17.Changes to these terms

We may update these terms as the Service changes. The version number and effective date at the top of this page identify the version currently in force. When we make a change significant enough to matter to your use of the Service, we'll ask you to accept the new version the next time you sign in, the same way we asked when you first created your account; smaller updates take effect when posted.

Continuing to use FGL after a change takes effect means you accept the updated terms.

18.Contact us
